1. Agreement to Terms

Welcome to Expert Check Inspections. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Expert Check Inspections ("we," "us," "our," or "Company"), governing your access to and use of our home inspection software and related services (the "Service").

2. Description of Service

Expert Check Inspections provides cloud-based home inspection software that enables professional home inspectors to:

• Create and manage inspection reports
• Upload and annotate photos
• Generate professional PDF and web-based reports
• Share reports with clients via secure links
• Access AI-powered features for photo analysis and narrative generation
• Store and manage client and inspection data

3. Account Registration

3.1 Eligibility

You must be at least 18 years of age and capable of entering into a binding legal agreement to use our Service. By using our Service, you represent and warrant that you meet these requirements.

3.2 Account Creation

To access our Service, you must create an account using Google Sign-In. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

4. Subscription Plans and Fees

4.1 Free Trial

We offer a free trial period that includes:

• 14 days of access to the Service
• Up to 5 inspection reports
• Limited AI feature usage (100 requests)

No credit card is required for the free trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

4.2 Paid Subscriptions

We offer the following subscription plans (prices in Canadian Dollars):

• Professional: $29.99 CAD/month — Unlimited reports, 250 AI requests/month
• Pro + AI: $49.99 CAD/month — Unlimited reports, unlimited AI requests

Prices are subject to change with 30 days' notice.

4.3 Billing

• Subscriptions are billed monthly in advance
• All fees are charged automatically to your payment method on file
• You are responsible for all applicable taxes
• Subscriptions automatically renew unless cancelled

5. Cancellation and Refund Policy

5.1 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to the Service until your billing period ends
• There are no cancellation penalties or early termination fees

5.2 Refunds

• No refunds will be provided for any subscription fees, including partial months or unused time
• If you cancel, you will not receive a refund for the current billing period
• This policy applies to both monthly and annual subscriptions

5.3 Exceptions

Refunds may be considered at our sole discretion in cases of:

• Accidental duplicate charges
• Technical errors on our part that prevented Service access
• Billing errors caused by our systems

5.4 Account After Cancellation

After cancellation, your account will remain accessible in a read-only state. You can view your past reports but cannot create new inspections until you resubscribe.

6. Acceptable Use

6.1 You Agree To:

• Use the Service only for lawful purposes
• Provide accurate information in your inspection reports
• Comply with all applicable laws and regulations
• Respect the intellectual property rights of others

6.2 You Agree NOT To:

• Share your account credentials with others
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or servers
• Scrape, copy, or redistribute our content without permission
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity
• Resell or redistribute access to the Service

7. Your Content and Data

7.1 Ownership

You retain ownership of all content you create using our Service, including inspection reports, photos, notes, and client data ("Your Content"). We do not claim any ownership rights over Your Content.

7.2 License to Us

By using our Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.

7.3 Your Responsibility

You are solely responsible for:

• The accuracy and legality of Your Content
• Obtaining any necessary permissions or consents from clients
• Backing up Your Content (we recommend exporting important reports)
• Complying with professional standards and regulations

8. AI Features

8.1 AI-Powered Services

Our Service includes AI features powered by third-party providers (OpenAI) for:

• Photo analysis and defect identification
• Narrative and comment generation
• Content suggestions

8.2 AI Limitations

You acknowledge and agree that:

• AI-generated content is provided as a suggestion only
• You are responsible for reviewing and verifying all AI-generated content
• AI may produce inaccurate or incomplete results
• AI features should not replace professional judgment
• We are not liable for any errors in AI-generated content

9. Intellectual Property

9.1 Our Property

The Service, including its design, features, code, documentation, and all related intellectual property, is owned by Expert Check Inspections. You may not copy, modify, distribute, or create derivative works without our written permission.

9.2 Feedback

If you provide feedback or suggestions about our Service, we may use such feedback without any obligation to you.

10. Disclaimer of Warranties

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or freedom from viruses

You use the Service at your own risk. We do not warrant that the Service will meet your requirements or expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPERT CHECK INSPECTIONS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from any content or conduct of third parties

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Expert Check Inspections and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or inspection reports

13. Termination

13.1 By You

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

13.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees
• Abuse or harass our staff or other users

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Content after a reasonable period following termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada, and you consent to the jurisdiction of such courts.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the modified Terms.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Expert Check Inspections
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms without our consent
